Many people do not realise that if there is a dispute within a family after someone has died that you may only have a very short time to put in claim under the Inheritance (Provision for Family and Dependants) Act 1975.
When someone dies it may be possible to apply for a Grant of Representation in the estate of someone who has passed away within a few weeks or months.
If someone wishes to put in a claim against the estate for example a partner or a child who expected to receive an inheritance and did not then that person only has 6 months from the date of the Grant of Representation to do so.
It may be possible to carry out a standing search to see whether a Grant of Representation has been obtained. It is possible for individuals to carry out such a search themselves or alternatively at Dodds Solicitors we can carry out a search on your behalf if you instruct us to advise you.
